All,

My organization had started an EB3 labor for me with PD of June 2004. However that was transferred to the backlog center and ultimately denied. In the meantime the organization provided me EB2 substitution with PD of December 2006 and applied for I-140 and I-485 concurrently for me in August 2007. I140 was approved in May 2008.

They gave me the impression over these years that they had assigned the PD of June 2004 to my EB2 process. However I just found out from USCIS service request that the PD is December 2006. Please advise if the PD of June 2004 is possible for the EB2 application.

You can only use the old priority date if the I-140 got approved. But you don't have an I-140 for the old labor certification.

You are only eligible for PD of December 2006.
