Request for Initial Evidence (I-485) for My Mother

Hi,

I recently filed concurrently I-130/I-1485 for my mother and I received Request for Initial Evidence for I-485 application for the following items.

1. Submit a copy of the birth certificate for the petitioner listed on form 1-130. The birth certificate must provide the parent names in order to properly establish the relationship between yourself and petitioner. If the is in a language other than English you must submit a copy of the foreign language document and an English translation.


2. Submit a copy of your birth certificated issued by appropriate civil authority. You must submit a copy of foreign language birth certificate and a full and complete English translation if the birth certificate is not in English.



Here is some information what we filled with application.

For the 1.

I only attached the copy my birth certificate/Affidavit in I-130 only. I did not include my birth certificate with I485. Also I am from pondicherry/India. My birth certificate has the names spelled in French spelling.

Do I need to translate the names which are written using French spelling ?



For the 2.

We didn’t have birth certificate for my mother. So we attached the following documents in I 485.
Birth certificate issued by Indian Embassy , Washington DC.
Affidavit from my mother’s uncle.

Do I need Non–Availability of the Birth Certificate.


If anyone faced the similar issue. Or Any pointers to what USCIS want for the RIE would be greatly appreciated.

Also an affidavit from your mother saying that she does not have any birth certificate, also letter from the corporation saying that she does not register her birth on the particular city where she born

Any body know what is the process on how to get Non-Availability of Birth Certificate ?

(Note : I did contact YourmanInIndia.com based on posting from this forum and they are looking in to this)

Also any idea on how to go about translating the names spelled in french ?
 
Hello. I wanted to just let you know that we had the same problem for my father-in-law. We were able to get the NABC from Chennai Corporation within a week using the services of yourmaninindia.com. They were very prompt in all their followup and got the document.
