Request for Evidence

We haven't received one yet. However, my wife was asking me about it last night. She went to her FP appointment yesterday and wanted to know when people usually get RFE if it is before or after the FP appointment. I said that if something was missing from the original package and it was mandatory then more then likely we would receive a RFE shortly after submitting the application. However, does anyone know exactly how USCIS processes applications: do they do a quick review when it is received, then wait for fingerprints and the FBI name check, then do a more in-depth review and if it passes send it on to DO for an interview?

I am asking because we are right on track to have an interview hopefully sometime in March. I just wanted to know when there was a time that was safe to say we were out of the woods of receiving an RFE.

Also it is upsetting me that her I-485 receipt number is not on the case status system on USCIS website. I had her call USCIS last week and 800 customer service transferred her to MSC. MSC said it takes up to 30 days from the receipt date to get online, and it still is not on.

Or during the interview. There is no set time table. If you dont get one within the first 5-6 weeks, you are unlikely to get one. Then, if the IO requires anything during the interview you have to furnish that information. There is nothing objective about the USCIS processes, every case is different!

To answer your question,if a RFE is going to be issued it is usually done after you take your fingerprints. But anytime is fair game for them to send you one, like the other responders stated.

Unless it some piece of critical evidence (e.g., missing affidavit of support information or citizenship documents of the petitioner), an RFE wont generally hold up your petition. But, like others mentioned, there is no time-frame when an RFE can come.
