Replacement of greencard with criminal past

Hi guys, I been reading this forum lately and it seems there is a lot of helpful people here, so I thought maybe someone could give me some advice with my situation.

I've been a permanent resident since 2004 and in 2008 I was arrested and I plead guilty to two counts, "Felony 4 Theft by Receiving" over $1000 dollars and "Misdemeanor 1 Theft" under $500 dollars, I got a deferred judgment for the felony 4 and was put on probation for 2 years.

Recently I lost my wallet with my green card and social, and I need to file for a replacement but I'm seriously worried because I read that the felony 4 is considered an aggravated felony under immigration law since the sentence could have been 2 years in prison. Will I get deported if I file for a replacement green card?

Thanks,

Charles

Hi Charles!

Your case is tricky. I would not apply for a replacement green card, instead I would just get another social security card. Do you have a legit drivers license? The green card replacement will require fingerprints. Get a good lawyer and when you file for your citizenship in a year or two , expect to shell out some real money!

Do you have a photocopy of your green card? What state are you in?

Wishing you the best! God bless.

He can't file the N-400 without a copy of the physical card.

Were you informed by your attorney or the judge of the possible immigration consequences of pleading guilty? If not, that may enable you to avoid deportation, especially if state law requires the judge or defense attorney to inform you of this.

I really don't think federal governmetn cares about this non-citizen must be notified of immigration consequence rule.

There are maybe exceptions but generaly if one can not renew the GC,
then forget about citizenship.
