Renewal of AP lost in Mail

One (I-485 adjustee) can not leave US without first obtaining AP. I-485 is treated as "abandoned". H/L people are exempt from this if they are in status.

You can enter US on H/L unexpired visa even when your I-485 was approved during your absense.

You can leave the country without AP and can send the approval my mail or some other way. But It will be problem if 485 get approved before AP approval. After 485 approval, there is only one way to enter into US, and that is AP.

Your replies are a little confusing.

The H4 visa has expired and I am not on H1 anymore. I have used my EAD for new job. If their Visa would have been valid then there was no point in applying or waiting for AP.

I went to the local downtown LA INS office. They said that my file is not there and hence they cannot do anything.
 
If you are using EAD then your dependant are no longer in H4 status; therefore, AP exception does not apply. This will mean that if they leave the country without obtaining AP, their I-485 will be treated as "abandoned"
 
I checked with my post office and they said it is hard to believe , all three mails ( My Son, Wife and myself) are lost. They said it is possible, INS did not post the mail. I also talked to IIO and she said, you should file it again. I also ask, Is there any other way to get the AP aprroval. She said INS is not responsible for misplace mail and you should apply it again.
 
wait for some more time, keep sending faxes to INS in this regard. As I said, in my case, it was mailed 8 weeks after approval (I saw the postmark).

INS mail room (specially the one that sends APs) is grossly mismanaged. It is highly unlikely that all three were lost. I wrote to news papers and political leaders about it. But, INS does not seem to care.

If every effort fails, you will have no other option but to refile. I think, then you can go to local INS (if you really have to travel), tell them your story (also mention that you had to pay fee again for no mistake of yours). Perhaps, they will give you AP.
 
AP rec 6 weeks after approval date

Hello Folks,

Here's my experience on this....

Applied AP renewal on July 05, 2002 (ND: 07/08/2002) and was
approved by INS-CSC on 07/31/2002 (per AVM)
I received my approval notice only on 15th Sept, a month and half after approval date. IIO told me that sometimes it takes 4-6 weeks to print and mail approval notices. I think some of you will see your notices in mail soon...Good Luck!
 
CSC to mail AP approval notice this week

AP ND is 07/08/2002.
AP AD is 07/31/2002 as per AVM.

Talked to an IIO on Friday and was told that the AP approval notice will be mailed this week.
