My friend is a foreign national (currently holding H1B) in USA. And, he came from one of the listed country that INS called for special registration. He went to INS local office last March, 03 for his special registration. They took his finger print and written FIN (Finger Identification Number) on his passport. INS officer told him that any person who is falling into this category wants to go out of USA, he/she have to attend to nearest INS office to inform on the day of departure and he/she have to leave within 24 hour time from the notice is issued.
His sponsored company applied GC for him (RIR -EB3). Company applied I-140 on last April, 03. And he applied I-485 on Last June, 03 with EAD and AP. His EAD and AP are approved and he is waiting for his I-140 approval.
Should he go for special registration before completing 1 year period as he already applied for AOS?
Can he go out of country and come back using AP?
Should he attend nearest INS office on the day of his departure (part of special registration policy) even he is planning to use AP while he is coming back?
