Renew an Expired H1b - what's the paperwork?

Hello,

This is my situation:

Company A sponsored my H1b visa in Oct 2008, which of course, it expired on Nov 2011.

Due to downsize reasons, i got laid off from Company A on DEC 2009. I decided to go back home. Now I have been here for about 2.5 years. Now I am thinking of going back to USA to work.

Although I left USA in Dec 2009, My h1b visa expired in NoV 2011, about 1 year ago.

I was wondering, In case I get the oportunity to go back to USA, Will it be necesary for me to get a whole new H1b visa, or is it possible to use the time I didn;t use of my expired H1b visa (about 2 years)? or course, by getting a new visa, i guess.

I heard that H-1Bs are closed for the upcoming 2013. I am not sure If i will need another h1b visa for the 2014 (which means my employer will need to wait for me the whole 2013), seems weird and doens;t make sense... it's easier for him to contact a US citizen employee.

Please let me know.
 
Renewal of Expired unutilized H1B

Hi,

I had an H1B approval through Company A and the dates shown on I129 are.
Receipt Date - April28, 2007
Notice Date - May21, 2007
Valid from 10/01/2007 - 09/15/2010

However I can see the status against my receipt as Initial on USICS and someone has told me that I can get it transferred to another company B since I never used this visa.

Please note I never travelled to US on H1B in this period.

Can you please tell me :--
1. If this can be revived?
2. For how long?
3. Under what clause?
4. What are the chances of rejection if any?
5. What is the time period for the same?

I will sincerely appreciate your help.
