removal of conditions

My removal of conditions is due next month. I am divorcing my USC spouse due to abandonment. Should I file my I-751 eventhough I am planning to submit the documents a week from now which is 20 days before the 90 day period. I have a good and stable job and my driver's license expires concurrently with my temporary green card. Will I be able to renew my license during this time?Please advise.
 
Unless your divorce is finalized, you have to wait until you're within the 90-day window to file the I-751. If you're not divorced, filing it before the 90-day period will result in rejection for filing too early.
 
If I file the divorce next week, it is impossible to have it finalized within the 90 day window. Is there anybody out there who knows long long a divorce should take (from filing to getting finalized)? We do not have children and no assets. I don't even know where to find him. What is the best thing to do? Can I file when ther is a pending divorce.

Only with the divorce papers you can apply for a waiver from joint filing for Form I-751 processing.First thing you need to do is check with an attorney asap for divorce procedures.Good luck!

Divorce is a family law matter which means it is regulated by state law and not federal law. So, each state has different requrements and time lines on how long it would take in order to receive a final divorce order. Again, as someone said it is best to speak with a family law lawyer about the divorce procedure in your state.
