Hello,

I am currently under removal proceedings. My U.S. wife filed
I-130/485/765 back in Oct 02 but our marriage has ended in divorce.

If I am offered a job with H-1 visa, will I have any problem with the H1 since I am under removal proceedings? If I file it after Oct 1 with premium processing, how long will it take to get the approval?

You can go out, get h1 stamp and come back.
15 days in most of the service center is the turnaround time for PP

Thank you very much for the info.

My next hearing is in Dec of this year. My student visa expired in Dec 01 and I was arrested in Dec 02 for overstay and released after my info was noted down.

If I go out now, doesn't the "3/10 bar" apply in my case? I have read that there's a 3 yr bar if the overstay is between 6mo's-1yr and 10 yr bar for more than 1 yr overstay.
