Hello folks, I need help, Also i will need a new immigration attorney as my previous one told me if i change employer he will no longer be able to represent me any more.
I was always H1-B, currently 6th and last year valid till 6/05( 3rd year employment). RIR oct 2002 in indiana not moved a single day since i filed currently processing April 2001, My employment location was underserve county in Indiana, so I also filed for NIW 11/03, I-140 & 485 pending for about 11months, Got EAD for myself and wife, She started residency using Ead near Chicago 6/04 so no longer H-4 any more.
Having problem with current employer as usual, mainly financial havenot got paid for 6 weeks . There are some terms and penalties in employment contarct but I guess breach is his behalf not mine.
My questions folks are,
1} I want to relocate to IL to close to my family( wife and 3 year old son), since she is already using EAd I need to file another NIW to keep her EAd valid should it be any MUA or it should be HPSA to file NIW with new employment.
2} I understand that NIW for H-1 is 5 years from i-140 approval, I want to keep my h-1 valid beyond 6 year(valid till6/05) and file a new RIR from IL( very fast) as soon as in jan/feb 05. can I get 7th year H-1 since my previous RIR which is over 365 days will void with move. But since i filed i-485( nov 03) its pending and 1-140 is not decided so far, will get qualified for 7th and onward yaersof h-1b.
Its very imp to keep nonimmigrant status valid in case any petetions get denied, rarely heppens to physicians, last but not least can i file a new niw 140 even my last one is not decided over 365 days ..
I will appreciate any help and person who guide me, and walk me through right steps.
I was misguided by my own friends and thats why i am suffreing( blunder of comming to Indiana state worst for RIR and going to underserve J-1 location witha a H-1B .

I did NIW&EB1 but it was self petitioned&based on my research & other work.both got approved . but I was always on H1, so I did not go through your suffering & hence will not be able to give any suggestions. sorry!
but I can recommend a lawyer who did a lot of NIW/EB1 cases ( mine also) many of my friends as well
check with this lawyer , he is kind of expensive , but very good
