Dear Forum Members,
I would greatly appreciate your time in helping me to make an important decision to relocate or not while my labor certification is pending. Thanks in advance for all your help!
Here is my situation:
---------------------
I work for a company in New York and my seventh year H1 extension has been recently filed. My labor certification was refiled during Oct 2004 in EB3 category, which I guess its now in one of the backlog centers.
My employer recently gave me an option to move to North Carolina If I want to, as they are expanding their operations in that state. Relocating is purely optional for me and I can stay back in New York if I want to.
Personally, my wife and I want to move as the cost of living is much less in NC than in NY and also more important for me, I can cut my commute time in more than half. But I am not sure one the following Immigration issues and would like to seek your help:
1. Does a new labor certificate needs to be filed again or an amendment for change of work location in the existing application is sufficient?
2. If a new application needs to filed does it needs to be a Perm?
3. Will I be losing some valuable time if an application needs to be filed again?
Since I am in the 7th year of H1, my priority is to get a green card and I can stay back from moving if that is the best option.
Based on my situation described above, I would like to thank you in advance for all your time in suggesting me a best possible solution
Regards,
Srikanth
