My AOS is based on an approved I-360 (Religious Worker) petition(pending since 5/02).
My attorney informed me that my wife and I must have our I-485 approved prioir to 9/30/2003.
The reason: The Religious Worker Special Immigrant category will expire as of 9/30. Yes, this also affects all pending AOS cases.
Every 3 years congress decides whether to continue or abandon the program. However, as of right now we have to live with the pending deadline (at least until Congress acts).
Many religous workers and their organizations are not aware of this issue. Does anyone know what the INS policy on AOS cases was in 2000 or 1997?
Can I obtain an official statement from INS regarding this issue?
