Relevant Date?

My ex-employer applied for my H1 B Visa, but later, he withdrew it before it got approved.Which is the relevant date :

1. The date of the letter from the employer informing the INS
requesting the withdrawal, or

2. The date when the INS acknowledges the withdrawal and
sends a letter informing about the closure of the H1B case.

relevant date for what

INS (if it sends) will send an acknowledgement with an date of withdrawal and that is final.
However, INS can withdraw a h1 retroactively too.
