Relative criminal record and citizenship

Hello All,

My relative is eligible to apply for citizenship this month Aug 01, but his friend filled a criminal complaint against him in Jan 2007. The case is still in the court and the trial date set in Feb 2010. My relative never been arrested my policeen, initially when the case start the court send him to police station for finger printing only.

He is wondering if he can get citizenship, my relative has a written evidence from the victim involved in the fight that my relative was not in the fight and his friend filled a case for money.

Any suggestions what should he do? Is it normal that the criminal goes for 3 years? or his lawyer just want to drag the case for money or the lawyer don't know what he is doing? or what happens if he fills for citizenship.

Will USCIS will revoke his Permanent status? By the way my relative also lost his green card 2 months ago?. If he reapply for green card will he get Green card back from USCIS.

Is it a civil trial or criminal trial?

If it is a civil trial, it doesn't have to be mentioned on the citizenship application.

If it is a criminal trial, he as a defendant has a Constitutional right to a speedy trial. His lawyer can file a motion to have the trial commence ASAP (months before Feb 2010), so it can be resolved before the citizenship interview.

It's Criminal case.In fact, my relative never incloved in this incident.
