rejection notice--any help appreciated

hello. i am a u.s. citizen. i'm trying to file the forms to petition my husband who is already here in the states.

we sent off the i-130(with money order for 355)

we sent the i-765 (with two money orders--one for 1000.00 and one for 10.00)

we sent the i-485(if i understand correctly we do not have to send a filing fee for this since we are filing the i-765 at the same time)

all this was mailed together along with all the other papers such as medical, biographic, etc...

we recieved the whole packet back and each of the three forms has rejected.

the i-130 says check incorrect or not provided--correct filing fee 355

the i-485 says check amount incorrect or not provided. correct filing fee 930.00 plus 80.00 fingerprint fee.

the i-765 says fee 340 but if we refile it with the i-485 there is no fee.

the only thing not returned in the packet was the ten dollar money order.

do you think the 10.00 money order was lost and that is the problem?? or did they use that to mail us back the packet??

or could the problem be that we sent two money orders(one for 10.00 and one for 1000.00) and it should have been one for 930.00 and one for 80.00.

or could it be that i as the wife signed all the money orders and my husband should have signed the ones for his i-485 and i-765??

i tried to call the number on the papers but only get automated responses.

we actually paid a paralegal to complete and mail everything off so it would be correct.

can anyone tell me what the problem is so we don't make another mistake??? i'd really appreciate any suggestions....
 
You need to send a check/money order of $355 with your I-130 form and a check/money order for $1010 (930+80) with I485. If you send one for $1000 and $10 all USCIS sees is "wrong filing fees" --> reject. If the max money order you can send is $1000, you can probably do one for $930 (I485 filing fee) and one for $80 (biometrics), but make sure to stick to those amounts, not 950 and 60 or anything, or you'll get the same response.

And for the record: the filing of I765 is free IF filing with I485, not the other way around.

PS. get your money back from the paralegal they obviously had no clue. If you have anyone do it for you make sure it is a reputable immigration attorney. But really, with some common sense and reading the instructions carefully you can do it yourself.
 
It is most likely the missing $10 money order. just get one money order for $1010 or put the money in your account and use a personal check instead and send back the complete package. If you must use 2 money orders make one for $930 and another for $80 that way USCIS can know one is for boimetrics and another for i-485. Also include a cover letter in package listing the contents and what you are petitioning for.
 
thanks so much for the replies. we were thinking we would send one money order for 930 and one for 80, and of course, the 355.. but i had never seen anyone here say to break it up like that. i thought so long it equaled 1010 it would be ok. and the limit was 1000 on the money order.

the money order has to have been misplaced though, i think. surely they couldn't take it to send the package back.

i thought--for some reason--that it had to be a money order. it's ok to send a personal check?????

Reading carefully is very important and will save you a lot of time and money especially with USCIS. Did you read AzBlk's response? He/she wrote clearly - deposit the money order in your account and send them a personal check.
 
yes, i read the reply---i'm sorry for asking again---just feeling so insecure through this process. i got the money order from my checking account thinking that was what i had to send---duh!!!

this forum is such a help to so many people like myself. thanks so much to all who contribute their knowledge and experience.
 
Just get a cashier check from your bank , one for 1010, one for 355, and send it back asap..
 
just to update in case anyone is interested. we sent back the package with a check for 1010 and a check for 355. it was accepted, checks cashed, shows up online, and we got our notification to have the biometrics done on 10/17.
