Regd out of state waiver

I am on H1B visa and my wife (H4 B visa) wants to go to school here. My green card processing is still in the early stages (State labor done, moved to federal). Does she need to pay out of state fees. I lived in this state for almost 2 1/2 years and been paying state taxes. Please reply.
