Hi,
We are planning for a baby. We plan to go to India in the 8th Month so that the baby is born in India. I am currently on H1 and my wife's on H4. A few months back I was on L1 and my wife was on L2. So we just have our legal status as H1 and H4 and we still dont have the VISA. I have two questions:

1) Whats the best way to get our passports stamped with VISA? Is going to Canada a good option?

2) If the baby if born in India and we have to come back, is a passport and VISA required for the baby? If yes how difficult is the process and in how much time will the VISA arrive?

Thanks for any help! Appreciate it.

You can go to Canada but it might be a good idea for the whole family to go together to the home consultae to get H1 and H4 visas.

Passport and visa are absolutely necessary for travel.
You should register the birth and get a certificate apply for the passport using Tatkal and then go fo rvisa.

In ur baby's case drop box is an option and it might be a good idea to write to the consulate and find out if you can take an advance appointment for the two of you and bring the baby along.

On another note a whole bunch of airlines do not accept visibly pregnan women after 32 weeks without a doctor's certificate.

Do cunsult ur doctor before making any plans.

Where to give birth to your child is a personal decision, but out of sheer curiosity, why not deliver the kid in the US so he acquires US citizenship at birth?

OP,

If you are willing to go back to India, you should go back before the 7th month. Most of the doctors suggest that you should not travel 'International' after 7th month.

On a side note, it should be possible to get Indian passport even if the child is born in USA as long as you register the birth and get the passport before one year from DOB.
