Regarding "service request"

Hello everyone

I called uscis on Dec,4th, i opened a service request , 1 week later i recieved a letter which stated this action and says i should recieve a decision in 60 days from the date of service request. my Q is do uscis commit this given time and i will recieve my EAD within these 60 days or it might go beyond 60 days? no LUDs on my I765 since i opened this service except 1 touch on my I485 after i went for infopass appointment on Dec,13th.

USCIS usually doesn't commit to anything so I wouldn't count on it if you have important plans. You should have received your EAD within 90 days of your application according to the law, unless you received an RFE for your I-485. But if you don't get it within 90 days, there's no more interim EAD so you basically need to wait. What information did you get at the infopass appointment?
 
hello austriacus it seems u are the only who answers my inquires everytime i post a thread in this forum.
i went to the infopass the lady was so nice she said theres no reason to wait all this time then she took my reciepts notices and went inside for 10 minutes and came later to tell me that she called NBC they told her that they needed a RFE and had them recieved on Nov12 was a day before my infopass she said u gotta recieve a decision on both cases I765&I485 within 60 days , 4 days later i recieved a LUD on my I485 that it has been resumed thats everything till this date, i opened a service request on Dec 4 and got a letter 1 week later from uscis which stated i opened a service request as i mentioned earlier in my post.

So do I understand correctly, you received an RFE, responded to it some time before Nov 12 and it was received Nov 12? Or was this some internal USCIS issue you were informed about? If they sent you an RFE and you responded and they received the evidence Nov 12, then the clock starts over and they have until 90 days from Nov 12 to issue you an EAD.
 
yes ive recieved a RFE on OCT and they have recieved these RFE on Nov 12. does it mean i have to start counting 90 days from Nov 12 ???? OMG . what about the earlier period of time ? by the way nothin has changed on I765 only on I485 has been resumed!!! another Q please .. i brought medical reports with me from home country when i came in the states , on may 30 2007 do i need to get a new medical reports later , i have not recieved any request for these though i am just wondering .these medical reports that i brough with me are valid for 1 year and the year already gone.
 
Technically, USCIS is only required to issue your EAD 90 days after you have submitted all initial evidence required for the I-485, or so it said in my RFE, and perhaps your RFE says it too. Yes, it's normal that only I-485 shows a resumed status (that's a good sign that it was resumed). Practically, at least when I applied in May, the EAD wasn't delayed another 90 days. It came a few weeks after the case was resumed. Now that the USCIS has apparently a lot to do, I'm not sure if they take the full time allowed under the law maybe - but know that the RFE probably started over your 90-day EAD clock and it should have said so in the letter you received.

When you applied for I-485 did you submit the medical exam info as required per the instructions for your particular case? Usually this is I-693 and the I-693 vaccination supplement, completed by a designated Civil Surgeon. If you entered in K1 status this may be different.
 
ive have submitted the AOS based on K3 visa , actually i am not sure what medical forms have been submitted since the lawyer who handled this case from beginning , about the RFE all ive been informed was to send a W2 taxes of 2007 of my wife , my lawyer who has recieved the RFE letter and asked me to send him a W2. the medical exam was taken in my home country before they issued me the visa by the us embassy, i brought an envolope with me and gave it to the IO at airport , its included the medical tests .

I suggest that if you want your EAD quickly, you should take a more active role in understanding what the lawyer has filed, what the RFE said, etc. ... at least to make sure your lawyer is doing the right thing on your behalf. I'm not terribly familiar with K3 medical procedures but I know there's such a thing as the medical for the K1 being acceptable for AOS so I suppose K3 has similar rules. I do believe there may be a vaccination supplement that has to be submitted, or perhaps it was submitted with the K3, maybe you can check. I suppose you need to blame your laywer for the delayed EAD for overlooking the missing W-2.

i think theres no need to blame the lawyer now , nothin will change anyway, i took another infopass appointment next week im going to find out where my case at . i heard that IRS asks for more decuments and copys later such W-2 , when my lawyer filed out my case he asked me to send him W-2 , later when the secretary called and asked for another copy of W2 i told her that i already sent you one when this case began she said that now the IRS needed aditional copy since the first one went to uscis. whether what she said was true or not i cant change anything.
