I'm currently on 10 yr multiple entry B1/B2 visa residing in US. I'm working as a research associate, voluntarily on a
non-stipendiary basis( no pay). My I-94 is expiring in 2007,october first week. Going to home country and re-entering US, leaving the project will cost me a lot, both financially and careerwise. In order to circumvent this, is it wise to go to Canada and then re-enter US within a couple of days? Since I have a
10 yr multiple entry visitor's visa to US, submitting
I-94 when i leave US and going to canada and coming back to US again as a fresh entry, is it considered safe and within legal limits? The law says that you have to leave US after the I-94 expires, does it mean you have to return to your home country or is it just you have to leave US(may be go to a different country) and then return again?

Also i should be applying for a canadian visa now, from US. In doing that, they would ask for the valid US I-94 and a return ticket to home country and also well within I-94 expiry , they ask us to be back in USA. how can we convince and submit I-94 before leaving USA. wont the canadian officials look into the validity of I-94?coz they would have asked it while we apply for canadian visa.
Would really appreciate if you could kindly suggest whether I would be safe doing this?
Thanks in advance.

First red flag. You should not be even using the words "residing in US" when you should be just "visiting".

Second red flag, "I'm working as a research associate". If you are not getting paid, how will not volunteering cost you a lot financially? B-2 are allowed volunteer work but with very strict conditions. The organisation must be a religious group or a humanitarian/charity entity.

What you are attempting to do is risky and may land you in hot water. Canadians may be relunctant in issuing you a visa since you are only a visitor to the US. Even if you get a visa, spending a few days in Canada and returning to the US to "volunteer" again may raise a lot of red flags at the POE. Put it this way, if I am having a hard time believing your story, a sceptical ICE official will too.
