Regarding 7th year h1b extension..

Hello, All.
I have 485 pending application.
I have completed my 6 years term on H1b.
In this 6 years i had been out of country for over 3 months.

Can i apply for my 7th year extension (after 6 years and a month is over already)?
Any suggestions will be helpful.

------ you were supposed to apply 7th year H1 before the expiry of your I-94, with I-485 filing reciept, if I-94 has expired you cant apply 7th H1 extension

Hello, Ginnu.
My I-94 is not expired, it is till feb'2005.
Looks like i got more than 6 years on h1.
Now do i need to apply for 7 th year immediately, is it ok for me to continue on H1 till I-94 expiration date?
My attorney says it is ok with pending 485( not necessary to apply h1 extn)
I appreciate your reply.

Looks like i got more than 6 years on h1.
-----I dont understand this if it is USCIS mistake then file 7th year H1 before your 6 years are compleate, count the 6 years from date of your first entry to US

Hello, I appreciate some input to my following question

My 6 year H1B expired on 16th June 2004 (a week back). I got my 7th year extension while my I140 was pending. The 7th year extension is valid upto 16th June' 2005. The I94 is also valid upto 16th June 2005. My I140 was denied 2 weeks after getting the 7th year extension.

Is the H1B extension still valid? My lawyer has filed another labor which was received by state labor on 1st June'2004. 365 days after filing this new labor will be over by June I'st 2005. Will I be eligible for 8th year extension after Ist June 2005? (As mentioned earlier, my 7th year extension is valid upto 16th June 2005)

---YES, you will need the evidence of that LC filing and evidence is Reciept from SWA or SESA ask the lawyer for LC filing reciept who filed LC
(As mentioned earlier, my 7th year extension is valid upto 16th June 2005)

I tried to post this as a new post but could not find a link to create a new post. I will try to do that.

The reason for my I140 denial is educational evaluation. My 3 year degree with 3 years of experience was not accepted equivalent to US 4 years degree and my labor did not have proper wording for the equivalency.(It simply said 4 year degree required)
