I have recently joined a consultant firm in the IT field as a consultant and i got my H1, approved on Nov 17 for that firm. He is yet to give me any papers regarding my visa.. Now, I have got a full-time offer from an employer who is in the Manufacturing Industry. I have the following questions

So will I be able to transfer my H1 without my consultant's help?

if then what is the procedure? and how long its gona take

Can someone help on my case...

Thanks and regards

Your post doesn't tell everything. You did not mention what was your status before you applied for this H1?

Thanks Eric,

I came to US on student F1 visa.
I graduated on this may and was on my OPT before migrating into H1.

My OPT started on July/7/2004 and was valid until July/6/2005.

I joined this consultancy during november, and got my H1 on Nov 17.

This is my opinion and I am not too familiar with OPT to H1.

Your new employer (Manufacturing Industry) can file a H1 transfer, but for that you have to have the previous H1 approval. So, yes, you do need your consulting company's help.
If new employer files a new H1, which I think is possible as you are on OPT, the problem is that H1 quota is already over and you do not have enough time to wait for next year's quota. I will recommend you talk to a lawyer and there might be a way out that new employer can file a transfer even when you do not have the approval notice with you.

The time it takes for transfer is 2 to 6 months and depends on the service center you are in. Check USCIS website at https://egov.immigration.gov/cris/jsps/index.jsp .If you do a premium processing($1000/- extra Fee), H1 can be done in 15 days.

Best of Luck!
