Refugee to immigration

Hi,

i applied for a Special immigration visa (SIV) and Refugee program on 2008 and both were going fine

i got approval notice I-797 for my immigration visa, at same time
my refugee case was faster and i left Jordan to USA.

Now i would like to complete my immigration application, when i contacted USCIS they informed me that since i am in currently in US i can not complete my SIV application.

any advice or comments about this issue and it is possible or not to change
my refugee case to immigration case?

the main issue for me that my company (US base) which i working for it, need me for their project in International Zone (Green Zone) in my original country IRAQ as i know that SIV people can visit the original country but Refugee can not.

i am currently hold Green Card.

Might be worthwhile making an infopass appointment and getting information in person. Your case is unique and might need different arrangements.

I got confused with your post. If you have a greencard, you have a greencard. Use your greencard and your national passport and work in the green zone, or you may apply for a reentry permit and work there. As far how your work in the green zone will affect your future immigration status, you should consult with the relevant entities that are involved. In my own opinion, I would consider the greenzone as a ok for US immigration purposes since they provide the security there...good luck

You already got your Immigrant Visa through the Refugee program & now have a green card. YOu can't apply for SIV or get adjusted based on SIV since you are already adjusted for permanent residency.

You are right that SIV people can visit their COP(since they are not refugees). I would suggest you wait till you become a USC to go to work in your COP.

returning to iraq as a refugee is definetlely bad when you are still a refugee but once you get the green card you are the same as an immigrant

although the site of usci state that an refugee should explain how he return to his country of origion when you return BUTTT in your case i think its ok IF you can PROVE your working for a US company at GREEN ZONE this is different becoz its safe PLUS you can even later apply for citizenship and the period you spent in iraq will be considered as part of your continous residency which means you dont need a re entry permit becoz this will break the cycle of continous residency

Thanks to all of you. i appreciate the answers and comments that you
posted.

1-I agree that on USCIS form of Travel Document there are one paragraph asking
if you are will visit you Original Country and need to explain your reason on separate paper.
therefore that mean it is possible to agree without problem about like this visit otherwise there no meaning to add like this question on the form.

2- Green Card though Refugee is different than Green Card through SIV
so the consequence that there is different information required when you fill up the Travel Document form.

3- my question Traveling with Green Card and current valid Passport no need to issue visa when return to USA and no need to travel document??


this site is wonderful and useful to me i just like see more confident answers
instead to personal interpretation to USCIS rules.
