I filed for I-485 in july 2000 under the court injunction with a pending EB2 and EB3 I-140\'s.
I got some RFE\'s for EB2 and it got rejected in June 2001, but my EB3 I-140 was
approved in Jan 2001.
In oct 2001 my I-485 was rejected stating that it was rejected because the EB2 140 was
rejected. Other reason stated was that I was not considered under EB3 quota
because when i filed in july 2000 EB3 was not current for India. My pending EAD
application has also been rejected. But I have an interim EAD from SFO valid till
Feb 2002. This card has not been cancelled and my attorney says that i can use the interim
card till it expires.
I have refiled I-485 using the EB3 140 because I never used this as if i am filing for the
first time.
Can anyone make sense out of my case and has anyone faced this kind of situation
and if someone has any suggestions ?
