I have questions abt Changing from Eb3 to Eb2.
1) What stage decides whether the application is Eb2 or Eb3? Is it the Labour certification or the I-140?
I have my Labour Cert (and I-140 approval) Under EB3. I was wondering if i can simply re-file my I-140 from the SAME job under Eb2? I know this sounds a crazy, that why wud u refile from the same job. But since Eb2 moves faster than Eb3, it may make sense.
So the question is Can i refile for EB2 from the same job WITHOUT Starting from scratch? IE, with the original priority Date (June 10 2003), simply re-file a NEW i-140 under EB2?
Now for the Next question.
2) Since i have an I-140 approval in hand, i read somewhere that i can Retain my Original priority date (June 10 2003) even if change employers. How far is This true?
If someone can please reply i would be greatly obliged.
