Today my girlfriend was to come but was denied entry and then sent back to DK. My gf was to visit for 90 days on the VWP. The immigrations officer saw that she previously visited for 88 days back in Dec 09-Feb 10. They took her in for questioning and presumably asked her what is her purpose here and what she did in her previous visit. She told them that she "helped out" at my work place and thus, concluded that she was working illegally here the last time she was here.
However, she didn't work. She just followed me to work and sat down all day long and watched me work. She was never paid for any services done. However, when the officer called me and told me that she stated that she "worked" in her last visit, I assumed that she did indeed tell the officer that she worked. I made A HUGE MISTAKE and lied about it, wanting to keep the story consistent with hers to avoid further trouble. This caused them to "verify" their suspicions and removed her.
However, they told her that she can reenter on a visa. After doing research, I'm thinking they mean the tourist visa. This would mean that she's not barred from reentry.
If this is the case, would this removal incident make us ineligible for a K1 visa in the near future?
And if not, is there some kind of process I can talk to an immigrations official to tell them the full story? I know lying is not good, but I lied and told them that my gf did an illegal thing, for which she did not, just to keep the stories consistent. I thought that if my story conflicted with hers, then it will have caused further problems. She said she "helped out" because she occassionally runs to find me and tells me about a task I have to attend immediately. I don't get how this is considered labor. She never made money and subsequently, did not make a living here, being that she paid for her expenses with her own money made from DK.
My gf stays with me for the 90 days that she's here and has a clean record and has never overstayed. The reason why they even took her in for questioning is because she came twice within a, I suppose, a relatively short period of time. We wanted to see each other frequently before we decide to take the K1 visa.
I would appreciate it if someone can help me as soon as possible. Thank you for reading. I am also seeking the help of an immigration attorney.
