Reenter after ban

hey guys

My name is Lukas, I am from Germany. I visited the US back in 2000 using the VisaWaiver Program. I overstayed the granted 3 months for about 2 weeks. On my way to Canada I got stopped at the border and arrested, even though I said I am about to leave the US. I was detained for 4months and given a 10year ban (which a lawyer I had consulted told me was unusual long for this short time of overstay but anyways...)
Well the ran out 2 years ago but until now I had no desire of visiting the US. Now my wife and I are planning a holiday this summer. If I wanted to go to the US could I use the wisa waiver program again?

thx
Lukas
Well

That is weird. Why would you have a 10-year ban? That ban is usually for people with at least 1 year of unlawful presence.

But anyway, that's not relevant now. If you have period of overstay, you probably can't use visa waiver, and need to get a visa.

I know. While in detention I hired a layer because I thought he might be able to get me out of detention quicker. After I got home I would talk to another laywer about my issue. Both of them were really surprised about the time of the ban. The paper I had received after being released from detention clearly states that I had been found guilty of overstaying about 14 days and had been given a 10 years ban.
Like I said until now I had no intention of returning to the US so I didnt care how long the ban was.

Anyways sometimes last year I tried to fill out an ESTA application just out of curiosity. And guess what I got an approval. I know the approval doesn't guarantee yet whether or not I'd be admitted into the US.
So my idea was flying into Canada and trying to enter the US by car. Would that be risky? They wouldn't put me into detention again would they?
