recommendation for approval

I had my green card interview today in Maryland and they said they were recommending me for approval but there is another step they need in order to improve. They said this could take up to 6 months. Problem is, I am leaving in a month to go home to have a wedding ceremony in front of my parents with my husband. The person who said we is recommending us for approval says we can do a advanced parole in place of the Green Card.

The problem is we already sent that form in July of '07 but it is still pending. We have a fax number we can request info but we got no response when we followed up in September of '07.

Are there any other options besides Advance parole that will allow us to leave and re-enter the country? I have read maybe about I-551 stamp on the passport. Also is that 6 month waiting time pretty average for a first time married, no kid professional wife?

Any help would be greatly appreciated.

You can get the I-551 stamp only after your I-485 application is approved. Did they elaborate on what could take up to 6 months? FBI name check for instance? Do you already have an advance parole document?
 
PonJon, what's your current status and have you been in status at all times before you applied for AOS?

We have been married throughout the process.

The person who interviewed us says she doesn't have the power to approve and has to send it to someone else for final approval. But she was recommending approval for us.
 
Oh, :D, what I meant was your immigration status, sorry. Some statuses allow travel without advance parole (if you have a valid visa to re-enter). And I'm asking if you've been out of status because it could be a problem to re-enter (even with advance parole) if you've accrued what's called "unlawful presence."

Oh sorry :)

When we got married and sent out documents, I was still in status. Although now after the long wait I am out of status now. I came on a J1 visa and it has expired.

Can you get an emergency travel petition in this case? I'm not sure they allow this for weddings in foreign countries, but i'm not positive.

I don't think so. We went to another department this afternoon asking about the status of our Advance parole and they said they can only process an advanced parole at their location if it is a life or death situation.

I doubt a marriage would qualify. We are still looking for other ways though since my husband and I and his parents have all purchased our flights and also have a place for a wedding booked.
 
I doubt that a wedding will be considered an "emergency." PonJon, that's ok if your status expired after you applied for I-485, because your lawful period of stay is extended for the duration that your I-485 is pending. So at least it looks like you don't have to worry about unlawful presence when you travel. I'm assuming you were not subject to the J-1 home residence requirement or had it waived?
 
Unfortunately unless you received your Advance Parole you should NOT leave the country...so you will have to think on Plan B if you can't travel and your parents and family members will have to hold on tight.

Your case is still pending so by law you are still subject to have an Advance Parole for traveling purposes.

It's normal that some IOS said that they can't approved it and they need a supervisory action, but never is about taking up to 6 months...do you ask why could take up to 6 months?

Thanks!!!!!!! That's very good news!!!! is it possible to get a stamp on the passport incase I don't get greencard ontime to go back home ???
