Recent Travel Experience with H1 on expired Passport

I have an H1 (valid till 2/2004) stamped in my old passport. I got a new Passport from the Indian Consulate in SFO, last year.

My attorney told me that the H1 in my old passport is considered valid. However, I would like to hear about recent travel experiences (through Hong Kong, Singapore or Malaysia) enroute India and back.

It may not be relevant, but my I-485 is pending with CSC.

My case was slightly different; don't know if it helps but here it is ...

My H-1B visa (the stamp) had expired in Oct. 98 but had changed two companies and possessed a valid H-1B approval notice. At this point, my passport was near its expiry and so I went in for a new passport in Jan. 99.

In Oct. 99, we visited India with a valid H-1B approval notice (my wife and I had our own seperate H-1B approvals) and a new passport in my case. We had no problems whatsoever in getting new visa stamps (on the new passport in my case) and came back to US ... again without any hassles!!

H-1B visa stamps are NOT timed with the expiration of the passports. So, there should be no problem if you happen to have a valid visa stamp on the expired passport and a new valid passport!

Just so you don't have to keep carrying two passports until the visa expiration, you may want to find out, after you have come back from India, if you can get a new stamp on the new passport by sending it to the state department. I don't know if this is possible but worth investigating. Good luck!
 
You gotto keep carrying both passports until you get a new visa and get the new visa stamped inthe new passport. DOS would not provide a visa stamp twice for the same visa- you have to go to the consulate (which will check whether the new passport is properly cross verified or not before providing the visa stamp)

Only thing you have to fear is fear itself:)
