Received Travel Doc

After an 8 months wait I finally received my TD yesterday. However I was dissapointed to find out that under the "CLASS" it still says "ASYLEE", eventhough I have benn adjusted to PR. Now I did apply for the TD in 8/2003 and was still ASYLEE then, but in 11/2003 was adjusted to PR.

The question now is it seems to me that the different departments do not have the same database and do not share information. It's like the old INS. I was very upset last night to find out this. I know some here got their TD with the PR residebt on it. I was to apply for avisa at the French consulate, but they have changed the policy for holders of TDs. It says it must say PR and they no longer accept ASYLEE.

So what do I do now. Is it BCIS fault? Can I return it to them and have issue a correct one? (which is risking another 8 months wait?) Go to the local office and have themn adjust it? What...

I have never seen an incompetent agency in an industrialised country as this BCIS.
 
your best bet is to go to germany (Asylees don't need visa) and then from there you can go to france.
apply for TD as a PR takes more than a year???

..........but I am no longer ans ASYLEE. Plus if I go to Germany and then onto France, don't I still have to show documents when entering France?

My whole frustration is that when I called the 800 #, and was checking on why is taking so long, I did explain that I was adjusted to a PR, but apparantly no one made a note of. Plus it seems like the database they have is not reflecting that my status has changed. So back to the same old INS problems.
 
This is the way they have always been and it is not likely to change--ever.

Just accept it and do not fight it.

Well, I disagree that you should not be mad.

I do see this forum as somewhat of a place to vent. There truly is no other audience with any understanding of what we are going through.

I honestly think it is completely illegal to deny entry for asylees and refugees completely. I am going to look into this.
How embarrassing for the French! I have no desire to even go there now.

I am really sorry for you. I would just apply for a new doc if you absolutely must go to France.

What will being "mad" do for you? There is nothing "illegal" about not admitting refugees and asylees. Each country is sovereign and can exclude whomever it wants.

Article 28. Travel documents

1 . The Contracting States shall issue to refugees lawfully staying in their territory travel documents for the purpose of travel outside their territory, unless compelling reasons of national security or public order otherwise require, and the provisions of the Schedule to this Convention shall apply with respect to such documents. The Contracting States may issue such a travel document to any other refugee in their territory; they shall in particular give sympathetic consideration to the issue of such a travel document to refugees in their territory who are unable to obtain a travel document from the country of their lawful residence.

2. Travel documents issued to refugees under previous international agreements by Parties thereto shall be recognized and treated by the Contracting States in the same way as if they had been issued pursuant to this article.
 
The inspection of people arriving in France from Germany is relatively lax (fellow EU members). Many people enter and leave on a Refugee Travel Document without any problems. But this is not 100% assured and you have to assume a risk.

Do you have a green card in hand? If you do, would showing that persude the French to issue you a visa? It is worth a try.

Or you can go back to the CIS and ask them to correct the RTD. Since it is their error, you can possibly ask them to expedite the correction. The best way to accomlish that is to get your Congressperson involved or ask your attorney to use the AILA liason process.

Thaks to all for your input. Now I wish I had them stamp my national passport, I would not have to deal with this.

Yes I do have my temporary GC. I suppose I can take that with me to the French consulate as evidence and hopefully they will understand that an error was made on BCIS's part.

I did write to the BCIS yesterday explaining what happened, and i am willing to wait and see what their response will be. I did say in my letter that I am not willing to wait another 8 months and am not willing to pay another $110, because the error was theirs. So the journey goes on..........

You cannot use the AILA process yourself, only attorneys who are AILA members can do that.

What about trying your members of Congress. I am afraid that your letter will not be read in time to make a difference.
