I switched my job on july 16th (similar industry and sort of same responsibilities). The same day my online status changed to RFE sent. I think the RFE would be about EVL and so on, if that is the case what should I do? Do i need to send EVL from new employer, or try to get one from old employer in back dates? My attorney is hired by my ex-employer and she will send response to RFE, as of today she does not know if I have quit my job. Any advice will be appreciated, thank u very much

RD: 03/21/02
FP: 04/01/03
3 EAD, EAP, 3rd is still in process, applied on 12/05/03
did not receive update e-mail from USICS

First of all no need to hide or do anything that may hurt ur case.

treat it as simple.

you have new job and as u mentioned its similar. so send them new current employer letter. that u have been hired... and theya re supporting ur GC.

Second also send the letter from ur previous employer that u worked from that date to current date u left employment. Why is that...????.

because u may have to send w2+recent-paystubs+old employment letter indicating that u were working....

and Plus u are also sending new employer who is going to support.... and few pay stub ++ whatever doc u can send to prove.

Also send the explaining letter even u don't need that...but just send it it would be good to help officer to understand.

Don't worry u all set.. just need some fine explaination and its better if ur Attorney gives in his letterhead.

Good Luck

I think no need to panic. Just wiat to see what exactly it is in the rfe. So many were in the same situation and got approved. You will be approved.

I did my fp's in April 2003 and i am assuming mine were
expired. Are your fp's still valid????

Another option

would be ............ if the old employer is agreeable, continue with them for another 10 days so that they can effectively send reply (treating you as an employee) and then relieve you to the new company. You can remain on vacation leave with them also. It wont hurt them in any way if they are good.

That way U can avoid other possible write ups from the new employer.

Just my 2 cents.

Thank u all

Thank u all. Today is my first day at my new work and I mentioned this to my HR, she will talk to Their attorney and let see what happend. As far as FP are concerns, I think they expired on July 16th, iI sent about 5 FP expiry letter to TSC and also informed my senetor.
