Received Request for Evidence (I-485) re income, please advise

I really need some advice, and I would appreciate so much if you guys can give us some advice.

We submitted the I-485 at the end of 2009, today we received a letter from USISC sayind that:

"Based on the documents submitted with Form 1-864, Affidavit of Support, for the petitioner/sponsor, the income did not meet 125% (100% if military) of the federal poverty line for the petitioner/sponsor's household size.

They say that we have to Submit evidence of assets that meet the standards or obtain joint sponsor, such evidence of assets includes:

• Bank statements covering the last 12 months, or a statement from an officer of the bank or other financial institution in which
the sponsor has deposits, including deposit/withdrawal history for the last 12 months, and current balance;
• Evidence of ownership and value of stocks, bonds, and certificates of deposit;
• Evidence of ownership and value/equity of other personal property and dates acquired;
• Evidence of ownership, a recent licensed appraisal or county assessment of any mortgage/lien or lien release of any real estate."

My question is, if we only send the total tax income for 2010 is this will be suffient evidence for my case?

You need to check the I-864P which will be updated soon. IF the currently received W-2 and/or 1099 show sufficient income now, then that will be good evidence.

Check the current income requirements.

The thing is that my husband has his own business and for our bad, last year he filed just a little bit of income for his 1040 and the schedule C was filed with all the income.

FY'10 he is filing around $40,000 for his 1040, I think this will meet the requirements even if the USISC update the I-864P, right?

Another question is since my husband has his own business he can't file the 1099, do you have any suggestions about how we can show proof of enough income? I'm just worry that the tax income for 2010 will not be enough. Do you think that I'm worrying too much?
