Received EAD cards for my out of status dependents

I was shocked to receive all 5 work authorization cards for my out of status dependents in the mail 10/17/07. After getting negative responses from my previous post here, I didnt expect that their application will be approved... but good thing they were.

My dependents have been out of status for more than 2 years now...

I wonder if their 485 will be approved too.

I just read through your previous post on your family's out of status issue. It is wishful thinking to even contemplate that their 485 will be approved. I would advise that you contact a good immigration lawyer who can file a 'nunc pro tunc' case for you ASAP. Delay is dangerous and could earn your family a ten-year entry ban!

I also made the same error believing that since I was in H1 status, my family's status was okay but I found out before they accumulated 180 days of unlawful presence.

Please, in order to avoid future heartaches, just follow the advise above.

I was sad after reading your reply y'day that you didnt received the EAD Cards for your family members, but again, in your this post, i read that you received EAD Cards for all your family members.

I am so much happy for you and congratulations to you, I can understand what must be going thru your mind and how much happy you would be.

I Hope I also get thru this tough situation and get the EAD Card for my wife along with mine. Going for FP tomorrow, Hope everything goes well.

I will talk to my Lawyer after If I get EAD for me and my wife, about if we should go ahead and apply for her Nunc Pro Tunc or not.

Are you and your lawyer really DUMB?

I thought most of the illegals here in USA - do not apply I-485 because they will get rejected....hence, they have been waiting for some relief from Congress (e.g 245i etc) to become legal and apply I-485 etc.... If all the illegals are waiting for that relief bill .....why the heck are you going ahead and applying I-485?

WoW, I guess - the only difference is - by applying I-485 - you are personally sending invitation to USCIS to deny I-485 and deport you...

AM I MISSING SOMETHING HERE - IN THIS ASSESSMENT??

Wouldn't the smart thing be - to apply the Nunc Pro Tunc route and become legal and then apply I-485??
I mean, shouldn't one take the best legal course to attain legal status??

I am just happy to share the info that even my dependents are out of status, they were able to secure work authorization still... so whats up with you being rude to me?

Just to let you know that I also received my wife's and mine EAD Cards in the mail today.

Going to talk to my Lawyer sometime next week to apply for my wife's Nunc Pro Tunc.

Lets Hope things gets straighten out for both of us.

What next should I expect from USCIS now ?, if anybody knows.

Also, The LIN #s when i got my FP is different than what its on me and my wife's EAD Cards, is that ok or is that a problem ?

EAD is fine but next time when your family is at port of entry while entering state immigration officers are quick to find out status/.
Fortunately I was always legal but Immigration officer upon checking my AP asked me for copies of my H1 and all EADs. Fortunately I had everything. So he marked date on everything just to make sure I was never out of state.

Find some good attorney to do some explaining for you. No offence meant but somewhere in my heart I have feeling Banta4gc and bigbang2001 are correct. How can you let such a big think slip for 2 years.

OK, I will not judge this guy, but I read some of his previous posts where he says he has 5 dependents including 4 kids ages - 16yo, 14yo, 10yo and 8yo. The biggest question I have is why was EAD applied for the kids in the first place. Seems like a lot of money down the drain to me. I don;t think the 8 year old is going to be earing any time soon.

Applying for a SSN could be a valid reason..(assuming the kids did not have SSNs before). Now, what is the realistic use of a SSN for kids is another question
