Recapturing time spent outside US

Hi,

My current I-94 is expiring in Dec 2002. I have spent about 6 months at a stretch outside US in 1998. My attorney says it is very difficult to recapture this time. Is this true ? My LC is in process at the TX DOL.

Also, my colleague in a similar situation, had 2 months and after applying for extension, he did not hear anything at all from INS until his 2 months also ran out. How long would it normally take INS to approve such an application ?

Could Jim Mills or anybody please shed some light on this ? It would help me take an important decision.

I have the same issue

My Company has applied for H1-ext for the
timeperiod i spent out of the US..

I spent 5.5 months ( vacation /unpaid)

They have applied at CSC centre.

 I have time until Aug 1st week..(6 yr expires)

 My attorney says it can be claimed back..
 Please post if anyone gets this time back.

my attorney says..

Says that we can apply for the extension for that time spent
outside (2 months in my case).

I have come across a guy who is been offered a 3yr H1 beyond
his 6yr limit. I guess it is a mistake on part of INS who overlooked
this. Not everyone is lucky as this guy!

I cant understand why there is no clear rule for claiming vacation time

Some say it should be unpaid leave
Otheres say it should be work related.
There are som many views.
Why are there no clear cut INS rules regarding
 capturing vacation time outside USA.
Every lawyer has his own opinion

My H1B 6years is runnug out in March 2003

I spent about 5 months outside US. My attorney thinks we can reclaim that time. But it is like any H1 extension and can be done only 6months prior to the expiration of current H1. Is it true?
