Recapture time on my H1-B [VERY URGENT]

Hi,
My comapny has filed I-140 for me, but I dont have enough time on H1 B left ( I have only 5 months and my 6 year of h1B +H4 time will expire), so we are trying get recapture time( when ever I was out of US) on my H1B to be safe. I have two questions regarding h1 B recapture.

1) I was out of US for 5 weeks in 2002 but that time I was on H4[/COLOR], can I use those 5 weeks for recaprture time on my h1 B ?

2) Recently I was out of US for a week for business trip, can I use one week towards recapture time on My h1 B ?

I do not see any problem with that as H4 and H1 are both counted towards 6 years.
I am in a similar situation as yours. Infact I am planning for a couple of months vacation and then recoup that period. Do you have any idea if one can work remotely from India and get paid here?
