recapture and 7th yr. extension together

My h1b will be ending in OCT 2009. Labor was applied in Dec 2008. I can recapture 380 days that i have spent outside USA.

Can I now apply for both recapture and 7th year extension together effectively extending my h1b until oct 2011.

My attorney says yes. As far as i know it is not possible.
Wanted to get confirmed about this so that i will not be in trouble afterwards.

Also, my job looks very shaky over here.
If I change the job can I recapture and extend my h1b (up to oct 2011) while transferring my h1b.

guyz please reply...as i mentioned my job is under threat. lot of layoff's are going on in the office. hence i am concerned. please guide help me.

This is regarding the same issue....
could anyone know typically how much time it takes for 7th yr. extension and recapture if I go for premium processing.

Company is not paying for premium processing, I need decide whether I need to go for a premium by observing the cost myself.
