Reason for the Delay...Some News to Relax

I'm talking about NIW case, not employee based cases.
BCIS tranfer NIW and EB1(not employee based cases)
because some are i highly alerted technology area,
like Semiconductor, defense, aerospace......

OK .. Here's what is defined as "EMPLOYMENT-BASED", per BCIS web site:
http://www.immigration.gov/graphics/howdoi/ImmStatEmp.htm
-----------------------------------------------------------------------------------
Who is Eligible for Employment Based Immigration?
There are five categories of employment based immigration:

First Preference (EB-1 priority workers): aliens with extraordinary ability, outstanding professors and researchers, and certain multinational executives and managers.

Second Preference (EB-2 workers with advanced degrees or exceptional ability): aliens who are members of the professions holding advanced degrees or their equivalent and aliens who because of their exceptional ability in the sciences, arts, or business will substantially benefit the national economy, cultural, or educational interests or welfare of the United States.

Third Preference (EB-3 professionals, skilled workers, and other workers): aliens with at least two years of experience as skilled workers, professionals with a baccalaureate degree, and others with less than two years experience, such as an unskilled worker who can perform labor for which qualified workers are not available in the United States.

Fourth Preference (EB-4 special workers such as those in a religious occupation or vocation): aliens who, for at least two years before applying for admission to the United States, have been a member of a religious denomination that has a non-profit religious organization in the United States, and who will be working in a religious vocation or occupation at the request of the religious organization.

Fifth Preference (EB-5 Employment Creation) If you would like to be granted immigrant status in the United States for the purpose of engaging in a new commercial enterprise, please see How Do I Become an Immigrant Through an Investment?.

somewhere on internet. And based on observations from this board, NIW get transferred mostly since Oct., 2002.

We are all experiencing frustration not to see many approvals lately. Let's at least appreciate magesh_kk's effort to try lift up our spirit.

Greencard MA( I am from MA too)

While I understand your view of being an optimist - it is also not very advisable to mislead already agonized 485 waiters with let's say less than truthful comments. Magesh has historically( at least last 1 year) done that and I think that hurts his credibility factor.

?????

I see some twisted mentality here. You hope BCIS transfers all categories except yours.

I don't think EB1 and EB2 NIW will have more employment problems. Why do you think BCIS should transfer them?

You have been complaining big time on this board about BCIS tardiness. Now you wish BCIS to do something extreme!!! Some people even suggested suspending I485 completely. Do you think you will support the idea? Keep in mind it is not only your case has been delayed. The whole process is being delayed. I would say BICS is doing something extreme already.

Obviously, to reduce backlog, VSC has to do sth extreme, like transfer all EB1 and EB2 NIW, since those cases are not based
on employment(and they have done some already). and tranfer all special registration country cases(they are doing that already).
They have to clean the backlog, it's terrible for them to process a case longer than 540 days.

what magesh said is high likely, new policy, could be FP expiration rules, could be new RFE rules....who knows. but sth
must be loosen up to let old cases go. Otherwise they will forever face backlogs and outside critics.

Hope our petition will do some good too. :)

It is somewhat true

This news seems true as I called my lawyer and the person told me that all the October- Nov 01 cases are being given attention to clear the backlog.

Let us see, how soon they clear it...

One question how long it is taking to renew AP/EAD these days??? response will be appreciated..

RD 10/01
NOTHING so far...

Dec cases seems completely stopped. I searched 800 cases for todays, and nothing happened.

how about Nov cases, any approval recently?

Maybe your lawyer heard the news from magesh_kk? :D :D :D

Where is Magesh....

Sound like what he said has basis. For two weeks, it has been so slow at VSC that visibly no movement at all.

The last few weeks have seen minimal case movements because it is summer time and people are probably out vacationing. Too bad our cases are piled up on some schmuck's desk while he/she is surfing the shores somewhere!

magesh_kk loves to spread rumours (as exposed by one of his last years posting). What he posted now is also his own imagination (which is untrue). I daily watch the approvals at rupnet. Yesterday 4 approvals are posted and out of them 3 are Jan'02 approvals. So it's not correct that BCIS has swooped on
clearing backlogs.

No, actually I found recently BCIS did clean some Oct/Nov backlogs. Hanxing just got his second FP notice after long wait.
I think they actually are taking look at backlogs, though not Dec cases. Dec cases are completely stopped right now.

Jan cases are still slowly in progress.

dengdeng

Mahesh has a history. Go back and see his posts around Oct/NOV last year. Even if he is correct now, given the background, it may be just coincidence. Donot give any importance.

this guy has a history of spreading his

wild imagination...

" in last sep 2002 he said, vsc is paralell processing OCt-NOV-Dec
from his internal sources..

Last month he said " there will be no approval till July 4 because of security reason" and after that there will be flood..

and now this.. what to believe..

but sometimes he forgets and asks

"is FP valid for 15 min from RD or ND date" why do you not ask this from your internal resource.. and give us a definite answer..

Hurray!!!

Hurray!!!!

Looks like people are back frm the training....(exactly 2 weeks)..

Let's wait & see for our approval to get posted....

:)
