I am going to get married Sep 8

My wife's company is ready to apply for L1-visa for tranfer to her US office

I have couple of questions. Could you Please let me know at the earliest

I applied for 485, got EAD and gave my finger prints on June 2002
and waiting for GC approval. I expect it to take FEb 2003 going by present
approvals (Vermont Service Center)

1) If my wife has a L1 visa, Can I still apply for her EAD and GC ?

2) Once she gets EAD if she resigns from the company or her L1 is cancelled
can she be still in status as she has EAD?

3) If she applied but did not get EAD by the time her L1 is cancelled will she
go out of status?

Answers...

1. Your wife can apply for I485 and EAD after coming into US in L1 anytime.
2&3 Status is determined by 485 pending receipt date . As long as 485 is pending she does not need any other visa for stay in US. For work she need valid EAD and for travel in and out of US she needs AP (apply I131 along with 485)
