Not only this is a anti immigration bill, but I also find this bill to be actually an anti asylee; what I mean by "anti asylee bill" is that people with real motives to apply for asylum will be sent back to their countries. In 94, the law changed that reduced a lot fraudlent applications in the asylee system. For sure, some changes should be made but not like that!

I agree with you, sir. After this bill is passed, they probably need more evidence for asylee adjustment, which the asylee didn't provide before. For example, they would need a goverment document from your country where you have sufferred from hardship. They need the evidence that should be issued by your goverment. If you say it is hard to get, maybe your adjustment will be denied. So Real ID is real danger.
 
In fact people play frauds not only applying for asylum! How many fake merriages are being registered every day? I heard that people send 4-5 applications for dv-lottery spelling their names differently and using different photoes and there were cases when they won lottery twice the same year. It's not only tha asylum status is specifically about many fraud cases. People are trying to stay in this country using all honest and criminal ways of doing that. Usually they do that because of economic reasons which can't be sufficient enough for immigration.

Senate Floor Vote -- April 11/12: A Senate floor vote on the supplemental is expected to take place on April 11 or 12. While there may or may not be an attempt to add REAL ID to the supplemental during the floor debate, we have been told that Senator Kyl (R-AZ) intends to introduce a free-standing REAL ID bill.

This bill proposes the following dramatic policy changes without any hearing or debate:

(1) Asylum: The REAL ID Act will deny refuge to those fleeing persecution by heightening the eligibility standards and evidentiary burdens governing asylum applications.

(2) Removal: The REAL ID Act will make noncitizens including long-time LPRs deportable for lawful speech or associations that occurred far in the past.

(3) Judicial Review: The REAL ID Act will broadly expand the restrictions on judicial review imposed by the 1996 laws. It also will eliminate the power of a federal court to temporarily stay a removal order while an appeal of that order is pending before the court. This means asylum seekers could be sent back to their persecutors before a final decision has been reached in their case!

(4) Driver’s Licenses: The REAL ID Act will link immigration status to driver's license eligibility and will deny driver's licenses to whole categories of noncitizens, thereby undermining the safety of our roads and the law enforcement utility of DMV databases.

(5) Bail Bondsmen: The REAL ID Act will subject noncitizens to bounty hunters who are provided unprecedented authority to "pursue, apprehend, detain and turn over" immigrants in removal proceedings.

(6) The Fence: The REAL ID Act will authorize the Secretary of Homeland Security to waive all federal, state, and local laws the Secretary deems necessary, in his sole and absolute discretion, to expedite construction of security fences and barriers at the U.S.-Mexico and U.S.-Canada borders.

MESSAGES:

(1) None of the provisions in this bill have been subject to hearings or meaningful debate. It is grossly irresponsible for Congress to enact legislation that could have life or death consequences under such circumstances.

(2) These provisions will do nothing to make us safer and, in the long run, will undermine our security by diverting precious resources and alienating immigrant populations here and our allies abroad. None of these measures would have prevented or impeded the 9/11 attacks.

(3) What would REAL ID really do? It would:

encourage the denial of asylum to Christians fleeing persecution, battered immigrant women, and others who cannot meet the harsh evidentiary and credibility requirements;


deny asylum to a Soviet Jew who was beaten and robbed by police, if he can’t prove that prejudice was his persecutors' primary motive;


permit the deportation of a legal permanent resident who donates online relief to a Tsunami relief fund that is a subsidiary of an organization in a Tamil Tiger-controlled region of Sri Lanka;


deny driver's licenses to a U.S. national from Samoa and to a trafficking victim seeking non-immigrant status;


deny a Guatemalan asylum seeker the right to remain in the U.S. until her case is finally decided, sending her back to her persecutors; and


permit construction companies to violate wage and hour, hiring, and occupational safety laws when they work on the border fence.

WELL in this case not only adjustment but the whole asylum case can be revoked. I don't really believe that will happend but who knows. I thiink the new rules will only apply for new asylum seekers.

proposal for those that are against Real Id

When you write, if you are against the Real Id (to clarify: I am against as it is), please mention in the begining (or highlight it) that you aprove the part of Title VII that remove the cap in the case of asylees seking adjustment to LPR. I am hoping that there might be a way (if Real Id don't pass) of them accepting or leaving the amendment removing caps to the budget bill, BUT WE HAVE TO ASK FOR IT WHEN WE WRITE. It's a long shot I know. It is essencial that we emphasize what we want too - cap removal. I don't know if you notice, but the cap removal is barely being talked about. If bill don't pass, we have to manage to keep this issue alive.

If you respond to the notice that says Please Help Write a Story for Wall Street Journal on top of the "Political Asylum in USA" forum home page, please please also mention our struggle.

For sure part of me want this bill to pass because I have an interest in that; however, I am an immigrant, and morally, I find this bill extremelly xenophobic, and ainti immigrant.

I agree. People need to learn about that stuff but this should not be achieved by misguiding them
 
I am really worried

I don't know what will be next or how this is going, I am afraid after we get our GC and become PR, they will reopen our cases or deny us citizenship, I have more than a big stack of papers and evidence about my case and it is all authentic, but the thought of going through that again just scares me :(

They do not reopen cases unless you use your national passport or worse yet go back to your country for a picnic.
