Delay of EAD Processing and BCIS Policy

People who have applied for EAD renewal must have noticed that they typically received a RFE asking to submit the government issued photo IDs. This plus other factors have caused a substantial delay in processing of EADs lately.

According to the AILA, it will be the BCIS policy not to back date the EAD validity date when they issue a renewal EAD card. This policy presents a serious problem for a large number of aliens who are working on EAD, such as the family-based I-485 filers, and the employment-based EB-485 filers who are not working on employment-visa status such as H, L, E, O, TN, etc. Legally, should the Service Center fail to issue a new card within 90 days from the date of EAD application filing, people are allowed to go the local field offices for issuance of Interim EAD cards. However, the reality does not always work like that. Some district offices take time to process such interim EAD cards.

Since the gap between the old and new cards creates a period of lack of employment authorization, any employment during this period can be considered an unauthorized employment. Such violation of immigration laws pending I-485 can make such alien ineligible for adjustment of status to a lawful permanent resident.

It is thus imperative that people start filing EAD renewal a way in advance, something like four (4) months, so that they do not face such risk in the green card track.

What is government issued photo IDs?
I applied for EAD for renewal . My Notice date is Feb 21 and Receipt Date is Feb 26th. My EAD expires on May 15. Now I am bit worried now even though VSC shows the current processing date 21 Feb 2003!! :confused:

Government IDS can be anything from Driver's License,
State Non-Driver's ID,maybe even your passport...

But that's stupid, since we already send them our EAD copy which itself is a Photo ID issued by them...

Do I have to get an EAD if I file for adjustment of status?

No. Once you have filed for adjustment of status, there are no additional penalties that attach if you fail to maintain lawful status by letting your nonimmigrant status expire, or accepting unauthorized employment. Your employer, however, can be penalized for employing you without permission.

What happens if my nonimmigrant employment authorization expires after I file for AOS if I don't have an EAD?
There is no penalty that attaches to an applicant for AOS. The applicant's employer, however, would be subject to being fined for employing the applicant without authorization.

What about an extension of employment authorization?

To be absolutely safe, apply for an extension of your EAD more than 90 days before your current EAD expires. If it is not extended within 90 days, you are entitled to go to the nearest INS district office and obtain your extension on the spot.

Apply for an extension of your EAD by filing a new form I-765 with the INS office that has your adjustment of status file.
 
I can only guess... maybe an RFE is issued if you do not attach the upper/detachable portion of your existing EAD approval notice.

But a quick comment on the policy itself: it's typical govt -- new organization, new policy! :(
