Re-use of co-worker's approved I-140

Hi,

I am asking for one of my friend.

One of the co-worker from my company has left the company and went back home for good. Is it possible to re-use co-worker approved I-140 for my 485 filing. My job description and co-worker job description are same. Please note, I have not started my gc (and don't have approved labor) yet but want to save time by using co-workers approved I-140.

Appreciate any response in this regard.

Yes you can. I have a friend who used his co-workers Labor. He used this labor and applied for 140.

May be not.

I know that you can use co-worker's labor for applying 140 as the labor is not specific to the person, but is specific to the job.I believe that 140 is specific to a person.So, you may not be able to use it to file your 485.

I am sorry I misunderstood the question. You cannot used somebody else's I140 but only their labor.

U Can definately use your co-workers I140. The LCA and I140 belong to the petitioner, 485 belongs to Beneficiary.
