Hi All,
I am working for a certain Company in NY but have filed
my Green Card(Labour Certification) from my friend's Company in
Chicago.
My question is at what point (140, 485 or later) do I have to
move over to my friend's company.

Would really appreciate any answers and does anyone know someone who has got his/her green card in such a way.

Thanks

Hi ks1974,

From what I understand, you are processing your GC through your friend's company as a "future employment". That makes me feel that you should be joining your friend's Company on getting your GC.

I haven't come across somebody doing this. But I can tell you one thing: You documentation should be very clear/accurate in your application.

Good Luck.

ks1974,

I guess, phildis is getting his GC done as a "future employment".

Check out his posts...in the thread "Strange situation....Need help" which is just below the thread that you started.

Cheers.

ks1974,

Wellcome to the world of confusion and anxiety!

As per the info I found on the websites (www.immigration.com, www.murthy.com etc.,), there are many who has got GC for future employment.

Well, I'm doing a lot of research about future employment, using the EAD etc.,

Here is what I have found.

1. The best thing is to apply for EAD along with I-485 and as soon as you get the EAD join the sponsor.

2. For GC for future employment you would usually get a RFE or Interview. At that time you have to convince the God (the INS officer!) that you really intend to join the sponsor after the approval.

3. There are some gray areas too.
They are:

a) No one knows if portability (changing the employer after 180 days of I-485 filing) is applicable to cases of this kind.

b) No one knows if one can use the EAD to work for a different employer other than the sponsor in cases of this kind.

Hope this helps!

Companies willing to do this probably aren't that big. So make sure they can out-last INS procedure.

There also may be an ability to pay issue and if the answer is that the employee will bring the customer with him, I don't think INS would find that sufficient.
