Re-entry using AP - Need immediate answer

Adance Parole

I have applied for advance parole on april 14th and got notice with the date 16th. I have to travel to India for urgent reason. What I have to do. Can I go wihtout the parole, as I will get one soon or do I have to contact local office to get one. Is it advicible to go without the parole document as I have already applied. Thanks for your help.

If you need to travel to attend to an emergency, you can request emergency AP at your local BCIS office. You will need to carry documentary proof of the nature of emergency. Such an AP is issued on a discretionary basis only.
You cannot return to US without either Advance parole or a valid non-immigrant visa like H1/H4.
 
you should not travel without approved AP

one more note :
you should not travel out of US without approved AP. Its considered your decision to stop GC process. INS might deny your 485 application on that basis.
 
Guys,

My wife is coming back to US after a short vacation and she has used EAD for work. She has AP for her reentry, but I read some posts in this forum that we also need to have 485 receipt along with AP to reenter US. She doesn't have the receipt with her and she is coming back today.

Is this true, can somebody share thier experience/knowledge?

Some time back me and my wife reenetered USA with AP. I did not have 485 reciept either, My lawyer had that. As long as she have a copy of the 485 reciept, it will be alright. The INS agent didnot ask for even a copy of 485.

Do not worry.

One thing though, if your wife is using the AP for the first time, they will do additional checks. Advaise your wife not to get alarmed.

I entered less than a week back...

with Ap. I did not need any document other than the passport and advanced parole. My husband was with me, and he didn't have his 485 notice either. It didn't matter!

You only need the AP

My wife went to India for two months and used AP to enter US at NWK intl airport. That is the only thing you need (and the passport of course!). The officer asked my wife for her social security number, which she did not remember and he said it is ok.
 
She should tell the officer that she has filed for AOS and would like to use AP. Most of the airports will have a separate queue for 'Parolees' (They have separate queues for students, non-immigrant visa holders, US citizens etc.) She should go there (if not, she'll be asked to go there anyway!)

We too used AP in Jan and all they saw was our passport and AP papers. They asked who was sponsoring our greencard (answer was: my husband's employer).

There is nothing to worry. It's a pretty simple process. Your wife should be ok!
 
They didn't ask much in boston airport. The INS officer asked us to take a seat and then he verified the validity of the AP in computer. It took 30 mins and he said this was necessary as we are using the AP for the first time.
 
Just Parole document and EAD should be fine. My wife re-entered during april and had no problem.

However here is an intresting case. Our Parole is dated 12/4/02 . We went to India in Feb 2003 and came back in april 2003. The airline's staff in India read the date of the parole in DD/MM/YYYY format and gave hard time. which my wife didnt understood clearly. I guess they put some type of entry in the airline database and allowed my wife to fly to USA. When my wife re-entered at the port of entry they asked the same question, "How can you travel before you get the parole?" and started checking much detail. Luckily one of the officer understood the situation and stamped the parole.

Guy's got to be very careful with the airline people also
 
The checks...

are nothing special. You stand in the line with millions of other people - once you get to the immigration officer, you tell him - I am entering on Advanced Parole. He will put your passport and papers into a file, and ask you to accompany another officer to a special room. You sit there for 10-15 minutes - they will call you by name and may ask for the last 4 digits of your social security number for verification (they asked us)

Then they stamp an I-94 and your AP, and let you go :) Make sure to get a stamp on your customs document from them also - they will stop you at customs otherwise...
 
AP Travel

As I've mentioned on another post elsewhere on this forum, I wasn't asked any document other than the AP and passport. It took all of two minutes for the officer to verify and stamp the papers and my passport. Lufthansa didn't even check for my travel docs at Frankfurt (I remember my earlier trip where they scanned the visa stamped on my passport, but this time they just looked at my boarding pass and allowed me to board). I did, however, carry the 485 receipt as a precaution.

PS: Reading the previous post, don't forget to hand over the customs declaration form also. I put the arrival/departure record, customs declaration form and the AP docs in my passport and handed over to the person behind the counter. And, at JFK, you need to sharpen your skills at sign-language. The officer used only hand signals to instruct me to handover the docs, to sit down and wait and, finally, to come collect the stamped documents. He seemed quite mad when I said my thanks to him with my hand -- I guess the use of just my middle finger got to him....Wonder why!!!

My wife has a H4 stamp (until 02/04) and she used EAD to work, so I've asked her to show AP and she DOESN'T have a copy of 485 receipt. She might be scared if she is escorted to other room as she has my kid to take care of. She is already on the plane so I can not talk to her. Hope every thing goes well.:( :(
 
my wife's I130 has been approved. I am a USC since september last year. My wife came here as a visitor and then changed to F1 visa . We got married after she has been to USA for 6 months, After finishing her ms she changed to H1. She got laid off from her job and within 4 months I have applied for her V visa and she is in V visa since then. I am going to apply for her change of status and advance payrole. Is it safe to travel to Bangladesh with Advance Pay role ?? I am afraid they might give her trouble when she will enter USA with advance payrole? should she travel with advance payrole?
 
I tried to get the advance parole from Arlington Office. They enquired the database and told as I have filed an I-131 at Vermont, they could not file again at this office. Instead they spoke with the vermont office and gave a fax number to fax the documents along with the medical report from India. I did everything and waiting for the results.

transit visa with ap

looks like this thread has a lot of people who have travelled on advance parole. did anybody need a transit visa? btw my going will be in air india via london and return via paris. asked the travel agent. he wasn't sure about the requirements of transit visa for france. called up the french embassy, although they had no idea what advance parole document was, they said if it is valid then there is no need for transit visa. however would appreciate response from people who have actually travelled or had friends/relatives traveling using ap. thanks

Deos you GC process stops when you are outside US on a vacation?
What happens when your PD becomes current and you are outside US on a vaction?
