Re-entry permit

Hi,
We have the GC which was approved in January 2004. We are planning to go back to India for sometime (1 year or more). We are planning to apply for the re-entry permit which will allow us to stay outside US with the GC for a maximum of 2 years. I have certain questions.

1. Do we have to stay in this country after applying for the re-entry permit till we receive the receipt. If so, how long would it take?

2. Can we give the address in India for the approval to be received?

3. How long does the approval take?

4. Will the duration of the stay be mentioned in the approval notice?

5. What other things need to be done to maintain the GC.

Any reply at the earliest would be helpful.

No, you can leave once USCIS has received your application. To be doubly sure, wait until you get the receipt notice.

2. Can we give the address in India for the approval to be received?
You can give either a residential address in the US or designate a US consular post abroad. The permit is NOT sent to a foreign residential address.

3. How long does the approval take?
Currently around 1 year.

4. Will the duration of the stay be mentioned in the approval notice?
There is no approval notice. You will receive a passport like travel document that has 2 year validity from the date of issue. Date of issue usually is or close to the date of approval.

5. What other things need to be done to maintain the GC.
Pay US taxes on ALL of worldwide income, continue to maintain a residence in the US, continue to maintain bank accounts, credit cards, etc. When you return you will have to prove that you have NOT abandoned US as your principal residence and the trip abroad was only temporary in nature.

The fact that you just applied for a re-entry permit, which by the way can take up to year or more (you do not have to wait for it) does not automatically guarantee your future re-entry. You need to maintain ties to the US, otherwise you may be refused your coming back! Ties are social, economic, etc like credit cards, bills, taxes, insurance bills, banking, house, schools, you name it!
Sell all and leave, then you will need a lot of luck to come back.
