Re-entry permit with baby born outside of USA

GC issue date: 16-Nov-04

Left US on: 18-Jun-05
Entered US on: 05-Nov-05
Left US on: 19-Jan-06

Re-entry issued on: 2-feb-06
Re-entry expiring on: 2-feb-08

India born baby: DOB: 29-Jul-2006

Now I am planning to go back to US. I would be traveling with my 1.5 old son (Born in India) and my wife (who is GC holder) with same dates as mine. This will be our first trip with baby. I understand that if I travel within 2 yrs of baby birth and if both the parents have valid GC then at the port of entry baby is admitted with temporary GC stamping and a card would be issued after certain time.

To establish my links to US I have the following documents

1. Self storage receipts. All my household stuff is lying in the self storage
2. Active bank account statements
3. Active credit cards and statements
4. Tax returns for 2005 and 2006 (Yet to file for 2007)
5. Valid Drivers License

Please advise on the following

1. Do I need to travel before 19-Jan-08 (2 Yrs from leaving US) or before 2-Feb-08 (Re-entry permit expiry date)
2. Any documentation for Baby besides Passport, Picture, Birth Certificate
3. What sort of questions can I expect at POE
4. Do I need to present US job offer at POE
5. Do I need to file 2007 (2005, 2006 are available) tax returns before entering US this month or can I file it before the deadline of April 08
6. Do I need to give any US communication/residence address for any formalities at POE?

Appreciate any help on this

Sorry, but there aren't many people out there in your situation. Most would have had the baby in the US or returned much more quickly after the birth.

Get a transportation letter for your child from the local US consulate. Here's some information from the US Embassy in Seoul (search for "LPR Child Born Abroad"):

You can file your 2007 taxes after you return.

Carry anything that you have at your disposal (proof of employment in the US, proof of U.S. residence, etc.) to establish that yours was a temporary visit and that you have not abandoned your status as a permanent resident of the US.
