Filed for CP and got Interview call from Delhi Consulate in June\'01---didn\'t go for interview and opted for AOS.
My case was very complicated as the file was in India. NVC didn\'t help much as I had submitted
packet-3 for interview in Delhi......Filed I-824 to get file back to US.

Well, it is coming for everyone...just some more wait for those expecting....

To Fresh : My RD July 2 nd , 140 CP still waiting

My 140 is approved for CP(Attorneys mistake) and was sent to Delhi consulate . Is there anything I can do to get the 140 Paper work back to INS Vermont.

Any feedback is appreciated.
 
Fresh, Congratulations and a question

How did you inform the consulate that you would not be attending the interview? Also, did you do anything to expidite the return of your file back from India?
 
I wrote a letter to Delhi Consulate informing them

of my inability to attend the interview and requesting to move the file
back to US. Then my father also called them on my behalf from New Delhi
to inform the consulate staff.

I did form I-824 to get the file back to US. The reason was that I spoke to an IIO
and she said this form is used to transfer file to and fro from INS.

I never used any attorney during my whole GC process and did everything myself.
 
To Yerkola: My understanding says that INS has

a record of everything and transfering files etc. is B.S. as everything is
electronic. You should be fine without the 824 form. I did it because the
IIO scared me last year as I didn\'t even attend the interview.

You seem to have a lot of knowledge as yopu did everything yourself. Please help me out.
My \'File\' was sent to Delhi as per NVC because I had indicated on my I-140 that I may choose to file CP. Apparently NVC sends file (incl 1-140) if you do not tell them that you have chosen to file AOS. Anyway, my AOS has been pending 10 months and I get an interview notice from Delhi even though I did not file Packet3!!! When I called recently, IIO here says that she cannot locate my 1-140 on their system (which tells me it may still be in India). What do you think I can/should do??
 
Logically if you don\'t send pkt-3, you should not get interview call from Delhi....

I think you should call Delhi consulate informing of your inability to attend the interview
and file form I-824(just to be on safer side) to move file back to US.....

INS should ask for the file from Delhi once they process your case....If you do I-824, you basically save
a few months....INS will still ask for your file from Delhi....
