Hi, My wife went to india & will be back on jun 30 on AP, she\'s working on EAD. I\'m planning to go to india next week & come back with her, i\'m still on h1, valid until july 2003. My question is if we both come back at a time, will the ins guy understand the situation about h1 & AP, or is it better to come on different dates. Could you please advice me. Thanks.
 
what\'s the difference between "come in different dates" and

"come in same date and different minutes with INS officer"?
 
I ment

If i come early or after her, i can use my h1, since it\'s valid. If i come with her to usa & if i show my h1 & if my wife shows her AP to ins guy, will the ins guy understand the situation.

I think it depends on the officer too. I was in a similar situation early this year. The officer did allow me on H1 and my wife on AP. I thought I needed to explain in more detail but the officer did not expect any explanation also.

Guys When immigration officer allowed you to enter in US, you had valid H1, did you mean to say also that you had h1 visa stamp or it doesn\'t matter as long as you have H1 approval notice.
