Hi Rapidigmers,

Would you please share your experience with regards to following issues:

(1) Can you share your experience leaving Rapidigm after 180 days using AC-21, and getting Green card ?

(2) They seem to be very vindictive. Do they revoke I-140 ?

(3) Is it a better option to stay with Rapidigm till I get GC even if I get real good opportunities elsewhere?

Experienced Rapidigmers, can you share your experience ? Your valued advice is highly appreciated.

Hi,

I also work for Rapidigm and have completed 180 days.
Came to bench recently. Got another offer but when I talked
to my recruiter he indicated that there will be trouble if I leave.

After you have worked for the sponsoring employer for 180 days, I don't see how they can cause much trouble with your immigration status. You may violate contractual provisions by leaving the employer but it's risky for an employer (particularly an employer with lots of H-1 employees) to sue a former employee.

After 180 days you are safe

Recently I read an article in Murthy Bulletin (search in www.murthy.com), wherein a company withdrew i-140 of their employee and INS sent a letter to applicant that his i-485 case is closed i.e Notice of denial or something like that (eventhough he had crossed 180 days). Note that not even RFE or Intent to deny. Straight away cancellation notice from INS.

Then the person contacted Murthy lawfirm (or any competant attorney for that matter). They sent a petition to INS again to re-open that case and INS agreed to re-open it. I will try to find and post this article.
Botton line is you are absolutely safe after 180 days. So do not worry.
 
If you crossed 180 days, have an opportunity, grab it. If you come on to bench they will not even try to arrange any interviews. They will even lay off you. This company sucks. Don't believe them. By now INS got used to AC21. Rapidigm can't even touch your case if you crosses 180 days.

But what about being laid off before 180 days? Various interpretation of AC-21 law at this senario. Kind of grey area. One board says that as long as INS doesn't adjudicate your case for the first 180 days after fililng I-485 you're Ok if you switch employer (voluntarily or involuntarily) before 180 days has passed. All I want to know is whether this is definitely the way that INS inteprets this law. But seems no one have a definite answer except providing individual cases.

No I am not a Rapidigm person, and yeah, I am in great fear of being laid off before 180 days.

Once the period of 180 days is over the original sponsoring company has no control on the I-140. You may change your job and move to another company wthout endangering the GC process. If you have followed the threads you would have read that so many people have changed jobs and got their GC. I see no reason why you need to worry. At the most the INS calls you for an interview and at that time you need to produse the employer's letter etc. Don't be scared.

GC is for future job. Your i-485 is filed based on i-140 from you sponsorer. That means they are offering a job for you in future. Most of the times we are already working for the sponsorers right from the begining.
How your sponsorer can withdraw GC petition ? answer is he withdraws i-140 for your application. Then your GC process terminates automatically. Till recently your sponsorer could do it even 3 days before approval date and stop your entire process.

But as per AC-21 law they can do so only till 180 days from RD of i-485. If you are laid off or whatever (or even never worked for them) as long as they do not touch your i-140 you are safe. Companies have no benefit withdrawing your i-140 unless they are vindictive towards you for some reason. So dont worry.. someone withdrawng your case is very rare. If their letter to INS reaches before 180 days your case is gone forever and you have to start all over again.

Only thing is you have to be employed in same or similar field as in your petition at the time of approval. INS may send you RFE sometimes to produce employment letter and paystubs. But they dont care where you are employed as long as it is same or similar field. The AC-21 regulations raise many questions I know. But that is beneficial for lawyers because they can convince INS using some loophole or other !!
 
Withdraw of 140

yes rapidigm does withdraw the 140. they are sneaky people. my suggestion, leave while you can.

did everyone know that jackie started her own law firm doing immigration work? i bet she would know the solution to their sneaky ways
 
Rapidigm will not withdraw I140

Hi Guys,

I am in the same boat. I did change employer before 180 days. They never with draw I-140. They always threaten you that they will withdraw. Please ignore them. They are fools. Its countdown for Rapidigm no. After INS approved I-140 & 485 filing at the same time who will stay with them. I heard they are not going to file I-485 until I-140 is approved.

btw , my recruiter (sucker) just bought a new house .

And why should I stay with them when they would lay me off as soon as I am out of project. I am negotiating with another company for a full time position and I am going to be out of Rapidigm soon.

isnt there some lawyer referral thing for attorneys you can call? or find out through the phone company?

thank goodness that you can file 140 and 485 together now but there is no way that they are going to do it they want us to feel like there is no where else to go
