I just got off the phone with my lawyer. What he is saying is I140RFEs would take
more time than the regular 140s, because the officer who is dealing with RFE cases
has to get the Orginal Labour Certification from the old file. To the question about
485 getting approved without I-140RFE, he said, sometimes it happens when an
officer is routinely going through his pending cases and if he finds our case then, he
could adjuducate it without waiting for I-140, based on 180 day rule. So the key is
our 485 files should fall in line for this to happen ( like it happened to Neo..). Bottom
line is "our luck"
