Raju/Alren etc,Please Advise: File AOS Or Continue With CP

Hi all,

The receipt date for my NIW at CSC is second week of January 04 and I have still not heard anything as the current processing date is March 10.

I had opted for CP Mumbai in my I-140.

I dont know how long this is going to take. My lawyer says we can take a chance by changing to AOS, so that at least we can get EAD.

Even though my current H1b expires in January 2006, obviously I would like to get my GC as soon as possible.

What should I do? Should I change to AOS? Or continue with CP?

If you advise me to file AOS,would it be better to file it right away or file it AFTER my 140 gets approved?

It is difficult to give an opinion where the 1-140 is not approved. The I-140 approval is the first solid reference point to estimate the time that would take to get your GC. Since the approval of I-140 is unknown here, the
attorney may be right is suggesting filing of 485 for obtaining the EAD.

The way you should calculate is 6 to 8 months to your GC from the time of
I-140 approval, if you remain with CP option. On the 485 side you should
consider the time line of your service center.

At the time we filed 140 in Jan 04, CP was still faster.Now it looks like 485 is getting faster. If we had opted for 485 back then, we could have expected the GC to be in hand anytime now with 140 and 485 getting approved together. :(

As of Oct 21, CSC is processing 485 of Nov 03.

IF we file 485 immediately after 140 gets approved, from your experience, would it make sense?

I know its a tough situation to give any opinion, but what would you advise?

{If you plan to file the 485 immediately after you got your approval, then
you realize that by staying with CP you can get your GC in roughly 7 months. I don't think you can get your 485 processed in 7 months time. But I could be wrong on this point}

I know its a tough situation to give any opinion, but what would you advise?
