How to raise awareness about labor certificate backlog

Sisters & Brothers:

Just some brainstorming ideas. Please do not judge them at this time. We can always judge them later, and select the best ones we agree with.

- Hire a lawyer
- Gather signatures at malls, and let Americans know our sufferings
- H1 One-day strike
- Send letters to local congressman, and DOL
- Group H1 based on their locations, and have regular meetings
- Tale one day or two days off, go to DC to let people hear us

We may end up nothing. At least we can dream. If we do not improve our own conditions, nobody else will help us. Like the domestic workers in the history, if they do not fight, their sons and daugthers today will suffer.
 
Is there anything illegal we are doing ? If not, why you haven't send mail/email/fax. If yes, then please explain, we can stop this awareness program.

Get out of selfish mentality that "let others send email, it won't make much difference if I don't "
Remember everybody thinks as you think, so give up your selfishness and do something for yourself.

Everybody who thinks that lobbying works better than waiting (specifically after waiting for 3 years), should add link to this thread in their signature.

I think, rather than 5-6 years of formalities (DOL labor, 140, 485), USCIS team should visit each company, analyze their financials and validity, and issue green card to all willing/qualified (working in US for more than 3 years or something) employees on the same day. Okay I am dreaming, time for me to go to bed :)

I totally agree. My friend works for JP Morgan in England. After certain years of employment, he was automatically granted a permanent residence in the country. US is still stuck with the age old bureaucratic processes. A person contributing to the economy for 5-6 years shouldn't be treated like a slave and made to go through this process. Above all I can't believe employees either at DOL or USCIS are any smart. The jobs are taken by people who can't find employment any where else. And the government is trusting these people to go through resumes/backgrounds/job profiles of some of the highly skilled people to make a determination. I think this country is going down.
 
I had contacted the WSJ journalist (posted on immigration.com) to check if he is intersted in writing our stories. Seems like he is more interested in writing about finger printing than labor certifications. Here is his response:

taken so often is that cases take so long to resolve. but since you have

been fingerprinted (with just two prints) as part of the visa renewal or
entry process.

for the purposes of this story, i can't discuss the labor certification
delay, but i would like to point out what the fingerprint situation is
for people like yourself, caught in the H-1-B trap.

Here's what we're thinking.. but we need unity

FIRST MESSAGE ----

Gentlemen and Ladies,

If you are serious about this I have a very effective proposal. I guarantee it'll turn heads but we can't do it if we dont have committment from a serious quantity.
I mean we need at least a 1000 (yes thousand) signatures.

Here's what I propose.

I'll write the letter and WAIT all day one day on a weekend outside the King of Prussia mall at a predesignated spot for each one of you to come and physically sign off on this paper - BUT I want to know we will have numbers and committment - I'd rather not be left standing out there and wasting my day if there's no commitment.

The letter will say:
The Legal Immigrant community is suffering because:

1. Delays with Labor certifications
2. No, absolutely no attention to their needs
3. Unfairness of PERM certifications prior to Backlog certifications
4. Other DOLs moving ahead with certifying applications upto Jun 2004 while Philly DOL cases are in a blackhole.

Then, with at least 1000 signatures, I will mail a copy of this letter to Senators from PA, NJ, VA, MD, NY, MA (and more if you say so) -
Also to the media.
To BPC
To DOL itself.

I am willing to put my name on the front - this could be foolish on my part but I am SICK of being treated like crap....

There's no way we can be ignored if we get together like this.
I know this will mean most of you will have to drive for hours (if you're coming from VA, MD, NY etc) but I'd like to know there is that kind of commitment if I am going to stand and wait for you to come and sign....

Let me know what you think.
We can start a thread OR document where I'd like to get people's commitment count started, by the end of May we can have these letters on the way iff there's the numbers behind it.

I can write the letter and put it out there in a thread for you sign off on --
I'll post my email address there you will :

1. Print document
2. Sign on it
3. Add your Full Name / Address / Contact Number
4. Scan the document
5. Email it to me

I will compile all these scanned documents and mail to senators / DOL / BPC etc...

If we dont have a good 1000 signatures we might as well let it go, our problem has always been we're not united and why should this be any different....

I dont know how to create a new thread but if someone does, please go ahead and create it ... with the above plan in mind...

I'll throw the letter in there along with instructions on what to do with it.

Please remember, we dont have any rights so this letter will HAVE to appeal to people's sense of fairness -- if you want to pick a fight, this is not the right petition.

Can we create an Excel file first, put our screen name in, and count how many want to take some actions. After a while, we start to send real sigatures and petitions to one person.

Let us discuss exactly what we want to do. Do not leave those who do not know what we are doing behind. Then we go together.

Can you send me a private mail, I will give you my phone number and we can discuss in more effective way.

I am serious and angry. I always believe if we do not do anything, nothing will happen. Like old blacks, they fought for their rights, not begged and waited.
 
Why not we get together at the source of the problem. BEC philelphia. That would be closer for NJ/NY ppl (who are hardest hit by backlog). Ideally we should get together somewhere in northern or central NJ because thats convinient for most of us. I know a huge park in central jersey where its easy to organize: behind Menlo Park mall in Edison.

2. Get screen names and locations
3. Divide nearby locations into several districts
4. Select one or two persons in each districts
5. We can do something at same time, different locations
 
I agree with you guys, I say we start off by creating a list of people in spread sheet, all people who are committed to do this can have their names in list.

The backlog in processing of immigration petitions is a real problem. Organizations, like the American Immigration Lawyers Association (www.aila.org), have lobbied Congress and the Department of Citizenship and Immigration Services to address the growing backlog. I encourage you to keep putting pressure on Congress to fix this problem. It's important that members of Congress hear from their constituents about the impact the backlogs are having.

I do not know if your situation can be remedied by a lawsuit. I fear that the issue will not be adequately addressed until our political leaders understand how people are being affected. I urge you keep up your advocacy efforts and organize your friends and neighbors to contact Congress.

But, my labor is filed at Denver as its the HQ for my co.
So, which congress member/senator should I contact ?

Friends,

I am in the same boat. However, here are some undisputable numbers from "2003 Yearbook of Immigration Statistics" that prove that the delays are unfortunately, more than some beuracrat's laziness, lack of funds, lack of awareness, etc.

Immigrants Admitted by Major Category of Admission: Fiscal Years 2001-03

Total
2003: 705,827 2002: 1,063,732 2001: 1,064,318

Employment-based preferences
2003: 82,137 2002: 174,968 2001: 179,195

Please note, that both 2002 and 2003 happened after 9/11. Nevertheless, without any significant changes in the law (quotas, etc.) between these years, just by mere sabotage of processing the total immigration was reduced by 1/3 and employment-based - by 53%!!!

These official numbers are shockingly illustrative. They prove that our ordeal is an obvious and undeniable (it's THEIR numbers!) sabotage. Please use these numbers everywhere, in all the petitions, letters etc. I think they can be a base for a lawsuit against the government.

The 2002 and 2003 editions of the Yearbook of Immigration Statistics and the 1996 through 2001 editions of the Statistical Yearbook of the Immigration and Naturalization Service are available on the Immigration Statistics page of the U.S. Citizenship and Immigration Services, Department of Homeland Security Internet website.
